TEXT ORDER entered by JUDGE WILLIAM L. OSTEEN JR. on 2/9/2010. A status conference and motions hearing is scheduled for Thursday (2/11/2010) morning at 9:00. The court would like to meet with counsel in chambers prior to the start of the motions hearing. The parties are requested to appear for the motions hearing in Courtroom 3 at 9:00. Once all counsel is present, the case manager will direct counsel to the chambers conference room. For purposes of the motions hearing, counsel may address any matters they deem appropriate. Each side will be allowed approximately 30 minutes for argument. During the course of any argument, the court requests the parties address the following issues:1. In construing the allegations of Plaintiff as to the existence of a contract, if this court should find that any representations by the coach of the Duke golf team are sufficient to create a contract, then consider the following:a. Plaintiff alleges that the Duke golf coach represented to Plaintiff that he would be given the opportunity to compete with his teammates to earn spots in the most competitive tournaments... (Compl. 13). Has there been a breach of that contract if Plaintiff in fact played on the Duke golf team for some period of time? In other words, is there a distinction between an opportunity to earn spots in competitive tournaments for some undefined period of time and eligibility to compete on a college team for four years?b. Plaintiff alleges that the Duke golf coach represented to Plaintiff that he would be given life-time access to those training facilities as an alumnus of the Duke Golf Program. (Compl. 13) If true, does such a representation implicitly incorporate certain conditions, such as any rules of the facility? Is access to the training facilities subject to a condition determined by the meaning of the phrase alumnus of the Duke Golf Program? 2. Defendants allege that the student publications neither constitute a contract or, under any construction of them, establish the contract that Giuliani claims exists. (Doc. 11 at 2.) If in fact the student handbook and various other publications do not form part of the agreement between a student and the educational institution, what does define the parameters of the relationship once a student is accepted and pays the tuition?
