Filing 60 MEMORANDUM OPINION AND ORDER. Signed by JUDGE JAMES A. BEATY, JR. on 12/9/2015, that Defendants' Motion to Strike (Doc. # 49 ) is GRANTED. Plaintiff's Response (Doc. # 48 ) is therefore STRICKEN from the record. It is FURTHE R ORDERED that Plaintiff has until and including December 16, 2015 to file a statement indicating whether he will withdraw his Motion to Dismiss (Doc. # 43 ). It is FURTHER ORDERED that if Plaintiff does not withdraw his Motion to Dismiss, t he following four orders become effective on December 17, 2015: 1) Plaintiff's Motion to Voluntarily Dismiss Without Prejudice (Doc. # 43 ) is GRANTED, subject to the condition that Plaintiff pay Defendants' reasonab le taxable costs associated with this matter; 2) Defendants Genuine Parts Company; National Automotive Parts Association; Sunex International, Inc.; International Speciality Services, Inc.; and Balkamp, Inc. are directed to file a bill of c osts no later than January 19, 2016; 3) Defendants' Motion for Summary Judgment (Doc. # 45 ) is DENIED AS MOOT; and 4) Plaintiff has until and including January 19, 2016 to file a motion for default judgment as to Defendants Shanghai Shengang Lifting Equipment Company and Shanghai Shengang Lifting Tools Company, Ltd. If no such motion is filed, Plaintiff's claims against Defendants Shanghai Shengang Lifting Equipment Company and Shanghai Shengang Lifting Tools Company, Ltd. shall be dismissed. (Daniel, J) |
