MEMORANDUM OPINION AND ORDER signed by CHIEF JUDGE WILLIAM L. OSTEEN JR. on 4/25/2014; that Plaintiff's Motion for a Temporary Restraining Order, Preliminary Injunction and Writ of Mandamus (Doc. 14 ) is GRANTED IN PART. FURTHER t hat the Department of Labor shall process all applications filed by Plaintiff International Labor Management Corporation for H-2A and H-2B workers in accordance with the statutory and regulatory deadlines, as follows: 1. The Department of Labor shal l issue a notice of deficiency or a notice of acceptance as to ILMCs H-2A applications within 7 days of receipt, in accordance with 8 U.S.C. § 1188(c) and 20 C.F.R. § 655.143 (a); 2. The Department of Labor shall issue a notice of deficienc y or a notice of acceptance as to ILMCs H-2B applications within 7 days of receipt in accordance with 20 C.F.R. § 655.31 and 20 C.F.R. § 655.33; and 3. The Department of Labor shall make, not later than 30 days before the date such labor or services are first required to be performed, the certification described in subsection 8 U.S.C. § 1188(a)(1) if the employer has complied with the criteria for certification (including criteria for the recruitment of eligible individuals as prescribed by the Secretary), all as set forth in 8 U.S.C. § 1188(c)(3).
