MEMORANDUM OPINION AND ORDER. Signed by JUDGE LORETTA C. BIGGS on 12/15/2016. Olive Garden's Motion to Dismiss and Compel Arbitration (ECF No. 5 ) is GRANTED IN PART AND DENIED IN PART. Olive Garden's motion is granted to the exte nt that arbitration is compelled pursuant to 9 U.S.C § 4 and this matter shall be stayed pending all matters determined to be arbitrable by the Arbitrator; and shall be denied to the extent that it seeks dismissal pursuant to Federal Rules of Civil Procedure 12(b)(1) and (6). Further, Olive Garden's request for attorney's fees and costs shall be and is hereby denied.(Daniel, J)
