FURTHER ORDERED that the Dismissal Motion (Docket Entry 6 ) is GRANTED IN PART and DENIED IN PART as follows: (i) Plaintiff's Retaliation Claim is DISMISSED for lack of subject m atter jurisdiction; (ii) Plaintiff's Age Discrimination Claim is DISMISSED for failure to state a claim; and (iii) Plaintiff's Breach of Contract and Intentional Infliction of Emotional Distress claims are REMANDED to the Superior Court of North Carolina for Guilford County.
