Filing 22 MEMORANDUM OPINION AND ORDER signed by JUDGE WILLIAM L. OSTEEN, JR on 03/29/2018, that Plaintiff's Motion to Seal, (Doc. 17 ), is DENIED. FURTHER that Defendant's Motion to Dismiss, (Doc. 13 ), is GRANTED, and this action is hereby DISMI SSED WITH PREJUDICE as to Defendant East Penn. FURTHER that this action is DISMISSED WITHOUT PREJUDICE as to Defendants Robert Collins and Jimmy Bobbit pursuant to Fed. R. Civ. P. 4(m), because Plaintiff has failed to serve Defendants Collins and Bobbit and attempts to serve these Defendants would be futile based on the reasons outlined in this Memorandum Opinion and Order. A judgment consistent with this Memorandum Opinion and Order will be entered contemporaneously herewith. (Garland, Leah) |
