FURTHER that Gabriel's motion for extension of time to serve (Doc. 31 ) is GRANTED and Gabriel shall have 30 days from the date of this order within which to serve the State Defendants, the State Defendants' motion to dismiss (Doc. 27 ) is DENIED WITHOUT PREJUDICE to its later consideration, Gabriel's motion to amend (Doc. 18 ) is DENIED.
