July 19, 2021	TEXT ORDER denying #104 Expedited Motion to Enforce Order and Modify Scheduling Order to Extend Mediation Deadline and striking any requirement for a further mediation. As reflected in #36 Joint Notice, the parties previously (unsuccessfully) mediated this case. Via Text Order dated 04/13/2021, the Court (per the issuing Magistrate Judge) adopted in pertinent part #102 Supplemental Joint Rule 26(f) Report's agreement by the parties "to participate in a[nother] mediation session within 45-days to 60-days of the entry of [that Text Order]." In #104 Motion, Defendant seeks an extension of that deadline, as well as a clarification regarding the terms of #82 Order. According to #105 Memorandum in support of #104 Motion, "[Defendant] believes that [ #82 ] Order is perfectly clear on its face. Nevertheless, because Plaintiffs persist in [what Defendant characterizes as a] misreading of [ #82 ] Order, [Defendant] submits that a short statement from the Court enforcing the clear directive of [ #82 ] Order that only the rounding claim was certified, and not an unpaid meal period claim or any other claim, will greatly facilitate the progress of this case toward either a negotiated resolution or dispositive motions." Defendant attached [105-2] Letter to #105 Memorandum, which confirms that Plaintiffs cancelled the scheduled (second) mediation due to a disagreement with Defendant over the terms of #82 Order. In #106 Response, Plaintiffs agree that "[ #82 ] Order is clear on its face" and therefore oppose Defendant's request for clarification. In addition, #106 Response asserts that Plaintiffs now object to the parties' previously agreed-upon mediator. In light of the parties' agreement that #82 Order is clear, no clarification of #82 Order is warranted, particularly given that the only concrete matter allegedly impacted by the parties' disagreement about the terms of #82 Order is a second mediation, as to which other disagreements have surfaced. Re-addressing #82 Order under these circumstances would amount to little more than an advisory opinion and a waste of the Court's limited resources. Via Text Order dated 03/25/2019, the Court adopted (with certain clarifications) #29 Amended Joint Rule 26(f) Report, providing for a dual-phased discovery process sandwiched around the Court's resolution of class certification issues, with a requirement that the parties meet within 30 days after such resolution to propose a Phase II scheduling order. The Court (per United States District Judge Loretta C. Biggs) issued #82 Order resolving class certification issues on 11/05/2020, but the parties have delayed until today to file #102 Supplemental Joint Rule 26(f) Report, which then proposes that discovery and dispositive motion practice stretch out for a further 13 months, such that any trial of this case likely could not occur until this case reached the four-years mark. Given the age of the case, the Court concludes that Phase II must proceed with greater alacrity. In addition, the parties' proposed schedule calls for discovery to end prior to the service of all expert reports, but contains language purporting to allow discovery after the disclosure of expert reports, sowing confusion as to what, if any, actual deadlines exist. September 16, 2019	TEXT ORDER confirming that, pursuant to the Advisory Committee Notes to the 2000 Amendment to Federal Rule of Civil Procedure 30(d), "[f]or purposes of this [Rule's seven-hour default] durational limit, the deposition of each person designated under [Federal] Rule [of Civil Procedure] 30(b)(6) should be considered a separate deposition." Amendments to Federal Rules of Civil Procedure, 192 F.R.D. 340, 395 (May 2, 2000). Defendant evidently would prefer to designate two witnesses because the deposition topics noticed by Plaintiffs generally fall into two distinct areas of Defendant's business (i.e., operations and human resources), but Defendant does not want to undergo 14 hours of depositions over two days. Defendant has proposed a compromise of nine hours over one day for two designees, but Plaintiffs apparently will not agree to anything less than the default allotment of 14 hours over two days for two designees. According to its #46 Supplemental Memorandum, Defendant therefore "will exercise its right to have a single witness testify as to the topics in this deposition, thereby remaining subject to the seven-hour limit." Notwithstanding Plaintiffs' pronouncement (in their #47 Supplemental Memorandum) of that "position [a]s simply untenable," Defendant, in fact, retains discretion to decide whether to designate one individual or more than one individual to testify in connection with Plaintiff's Notice of Deposition under Federal Rule of Civil Procedure 30(b)(6), see Fed. R. Civ. P. 30(b)(6) (observing that, when served with such deposition notices, corporate entities "must then designate one or more officers, directors, or managing agents, or... other persons who consent to testify on its behalf"). Reasonable parties likely could find a reasonable accommodation that serves each side's reasonable interests. See Amendments to Federal Rules of Civil Procedure, 192 F.R.D. at 396 ("It is expected that in most instances the parties... will make reasonable accommodations [regarding the duration of depositions] to avoid the need for resort to the court."). TEXT ORDER denying #104 Expedited Motion to Enforce Order and Modify Scheduling Order to Extend Mediation Deadline and striking any requirement for a further mediation. As reflected in #36 Joint Notice, the parties previously (unsuccessfully) mediated this case. Via Text Order dated 04/13/2021, the Court (per the issuing Magistrate Judge) adopted in pertinent part #102 Supplemental Joint Rule 26(f) Report's agreement by the parties "to participate in a[nother] mediation session within 45-days to 60-days of the entry of [that Text Order]." In #104 Motion, Defendant seeks an extension of that deadline, as well as a clarification regarding the terms of #82 Order. According to #105 Memorandum in support of #104 Motion, "[Defendant] believes that [ #82 ] Order is perfectly clear on its face. Nevertheless, because Plaintiffs persist in [what Defendant characterizes as a] misreading of [ #82 ] Order, [Defendant] submits that a short statement from the Court enforcing the clear directive of [ #82 ] Order that only the rounding claim was certified, and not an unpaid meal period claim or any other claim, will greatly facilitate the progress of this case toward either a negotiated resolution or dispositive motions." Defendant attached [105-2] Letter to #105 Memorandum, which confirms that Plaintiffs cancelled the scheduled (second) mediation due to a disagreement with Defendant over the terms of #82 Order. In #106 Response, Plaintiffs agree that "[ #82 ] Order is clear on its face" and therefore oppose Defendant's request for clarification. In addition, #106 Response asserts that Plaintiffs now object to the parties' previously agreed-upon mediator. In light of the parties' agreement that #82 Order is clear, no clarification of #82 Order is warranted, particularly given that the only concrete matter allegedly impacted by the parties' disagreement about the terms of #82 Order is a second mediation, as to which other disagreements have surfaced. Re-addressing #82 Order under these circumstances would amount to little more than an advisory opinion and a waste of the Court's limited resources. TEXT ORDER adopting in part #102 Supplemental Joint Rule 26(f) Report with the following modifications: (1) Plaintiffs shall serve their expert report(s) by 09/03/2021; (2) Defendants shall serve their expert report(s) by 10/01/2021; (3) Plaintiffs shall serve any rebuttal expert report(s) by 10/15/2021; (4) the parties shall complete discovery by 10/29/2021; (5) the parties shall file any dispositive motions by 11/29/2021; and (6) the Local Rules of this Court (not the neighboring court to the east) govern this case. Via Text Order dated 03/25/2019, the Court adopted (with certain clarifications) #29 Amended Joint Rule 26(f) Report, providing for a dual-phased discovery process sandwiched around the Court's resolution of class certification issues, with a requirement that the parties meet within 30 days after such resolution to propose a Phase II scheduling order. The Court (per United States District Judge Loretta C. Biggs) issued #82 Order resolving class certification issues on 11/05/2020, but the parties have delayed until today to file #102 Supplemental Joint Rule 26(f) Report, which then proposes that discovery and dispositive motion practice stretch out for a further 13 months, such that any trial of this case likely could not occur until this case reached the four-years mark. Given the age of the case, the Court concludes that Phase II must proceed with greater alacrity. In addition, the parties' proposed schedule calls for discovery to end prior to the service of all expert reports, but contains language purporting to allow discovery after the disclosure of expert reports, sowing confusion as to what, if any, actual deadlines exist. TEXT ORDER confirming that, pursuant to the Advisory Committee Notes to the 2000 Amendment to Federal Rule of Civil Procedure 30(d), "[f]or purposes of this [Rule's seven-hour default] durational limit, the deposition of each person designated under [Federal] Rule [of Civil Procedure] 30(b)(6) should be considered a separate deposition." Amendments to Federal Rules of Civil Procedure, 192 F.R.D. 340, 395 (May 2, 2000). Defendant evidently would prefer to designate two witnesses because the deposition topics noticed by Plaintiffs generally fall into two distinct areas of Defendant's business (i.e., operations and human resources), but Defendant does not want to undergo 14 hours of depositions over two days. Defendant has proposed a compromise of nine hours over one day for two designees, but Plaintiffs apparently will not agree to anything less than the default allotment of 14 hours over two days for two designees. According to its #46 Supplemental Memorandum, Defendant therefore "will exercise its right to have a single witness testify as to the topics in this deposition, thereby remaining subject to the seven-hour limit." Notwithstanding Plaintiffs' pronouncement (in their #47 Supplemental Memorandum) of that "position [a]s simply untenable," Defendant, in fact, retains discretion to decide whether to designate one individual or more than one individual to testify in connection with Plaintiff's Notice of Deposition under Federal Rule of Civil Procedure 30(b)(6), see Fed. R. Civ. P. 30(b)(6) (observing that, when served with such deposition notices, corporate entities "must then designate one or more officers, directors, or managing agents, or... other persons who consent to testify on its behalf"). Reasonable parties likely could find a reasonable accommodation that serves each side's reasonable interests. See Amendments to Federal Rules of Civil Procedure, 192 F.R.D. at 396 ("It is expected that in most instances the parties... will make reasonable accommodations [regarding the duration of depositions] to avoid the need for resort to the court.").
