Filing 4 RECOMMENDATION AND ORDER as to ANTWAN O'BRIAN LLOYD, Signed by MAG/JUDGE L. PATRICK AULD on 7/19/2019. ORDERED that in forma pauperis status is granted for the sole purpose of entering this Order and Recommendation and that the Clerk return the $5.00 filing fee to Petitioner. FURTHER that Petitioner's Motions (Docket Entries #2 , #3 ) are denied as moot. FURTHER that the Clerk send Petitioner a copy of this Recommendation and instruction forms for filing 2255 motions in this Court and Motions for Authorization in the court of appeals, and five copies of 2255 motion forms (more opies will be sent on request). Petitioner may use one set of forms to file any 2255 in this Court challenging his revocation sentence. As for the others, Petitioner should use them to seek permission from the Fourth Circuit to raise any challenges to his original conviction or sentence and should keep the original and two copies of the 2255 motion which can be submitted in this Court if Petitioner obtains approval from the Fourth Circuit. RECOMMENDED that this action be filed and then dismissed sua sponte without prejudice to Petitioner raising his claim challenging the computation of his sentence in his district of incarceration, bringing his claim challenging his revocation sentence in a 2255 motion in this Court, and/or pursuing his claim attacking his original conviction and sentence by seeking certification for a second or successive 2255 motion through a Motion for Authorization in the court of appeals as required by 28 U.S.C. 2255 and 2244 and Fourth Circuit Local Rule 22(d).
