| TEXT ORDER granting #7 Plaintiff's Motion for Leave to File First Amended Complaint and Modify Caption. Plaintiff seeks leave to amend her complaint to correct Defendant's name to "The University of North Carolina at Chapel Hill" pursuant to Federal Rule of Civil Procedure 15(a)(2), which allows a party to "amend its pleading only with the opposing party's written consent or the court's leave." Fed. R. Civ. P. 15(a)(2). Plaintiff indicates that Defendant consents to Plaintiff's motion. However, Plaintiff is entitled to amend her complaint as a matter of course because Defendant has not yet filed any responsive pleading. See Fed. R. Civ. P. 15(a)(1)(B). Plaintiff also requests that the caption in this case be modified to reflect Defendant's correct name. Therefore, pursuant to Rule 15(a)(1)(B) and for good cause shown, the Court will GRANT Plaintiff's motion. IT IS HEREBY ORDERED that Plaintiff shall file a copy of her First Amended Complaint consistent with Exhibit 1 of her motion (Docket Entry 7-1) within five (5) days of the date of this Order. IT IS FURTHER ORDERED that the Clerk shall correct the caption in this case so that Defendant is properly named as "The University of North Carolina at Chapel Hill." Issued by MAG/JUDGE JOE L.
