| TEXT RECOMMENDATION that the Court dismiss this action without prejudice under 28 U.S.C. s 1915(e)(2)(B), as frivolous and for failure to state a claim. The entire statement of claim in #2 Complaint appears as follows: "The defendant has violate [sic] the federal law under the guidelines of the cdc 'code 42.'" That conclusory statement fails to state any plausible claim and falls short to such a degree as to render this action frivolous.
