TEXT RECOMMENDATION that the Court dismiss this action, pursuant to 28 U.S.C. s 1915(e)(2)(B), as frivolous and for failure to state a claim. In #2 Complaint (filed along with #1 Application to Proceed in District Court without Prepaying Fees or Costs), Plaintiff purports to sue the United States Postal Service, the Internal Revenue Service, and an unnamed Postmaster, under 42 U.S.C. s 1983 (and its criminal counterpart, 18 U.S.C. s 242) for a Fourteenth Amendment violation because he only received one federal stimulus check and believes he should have received two federal stimulus checks. The United States Postal Service, the Internal Revenue Service, and United States Postmasters are not state actors subject to suit under Section 1983 (or to liability under the Fourteenth Amendment), Plaintiff may not proceed against the named Defendants (or anyone else) under Section 242, and the allegations of #2 Complaint do not state any conceivable federal constitutional claim against anyone because they could not support a finding of any intentional misconduct (but, at most, may allege negligence).
