Defendants filed a Notice of Removal in this case, identifying the principal place of business for the Plaintiff Truliant Federal Credit Union and for Defendants Bethpage Federal Credit Union and Bethpage Commercial, LLC. For purposes of diversity jurisdiction, a federally chartered credit union is a citizen of its principal place of business. Navy Federal Credit Union v. LTD Financial Services, LP, 972 F.3d 344 (4th Cir. 2020). However, because the citizenship of an LLC is determined by the citizenship of its members, the Court directs Defendant Bethpage Commercial LLC to file a supplement within 7 days, naming --and identifying the citizenship of-- each of its members (and if the members are LLCs or LPs, the citizenship of the members or partners, and so on, traced back to corporations or natural persons as the case may be) to confirm the basis for diversity jurisdiction.(Garrett, Kim) |
