Filing 13 DENIAL OF ENTRY OF DEFAULT denying #12 Motion for Entry of Default. This matter comes before the undersigned Clerk of Court upon Plaintiff's Motion for Default Judgment, which was filed on March 27, 2024. Because default has not been entered in the case, Plaintiff's motion will be treated solely as a motion for entry of default. On February 26, 2024, the Court ordered the U.S. Marshal to serve the summons and complaint. However, neither the docket nor Plaintiff's motion show any evidence that Defendants have yet to be served by the U.S. Marshal. Federal Rule of Civil Procedure 55(a) requires a clerk to enter default when a defendant has "failed to plead or otherwise defend." In this case FRCP 55 has not been met as Plaintiff has not demonstrated that Defendants have been properly served and have an obligation to file an answer.
