April 16, 2024 Filing 7 ORDER signed by MAG/JUDGE JOI ELIZABETH PEAKE on 04/16/2024, that the Motion for Leave to Take Discovery [Doc. #5 ] is GRANTED, and Plaintiff may serve ISP Spectrum with a Rule 45 subpoena commanding Spectrum to provide Plaintiff with the true name and address of the account holder to whom Spectrum assigned the Internet Protocol ("IP") address as set forth in the Complaint. Plaintiff shall attach a copy of this Order to the subpoena. Spectrum must provide notice to the account holder prior to releasing the account holders identifying information to Plaintiff, and if Spectrum and/or the account holder want to move to quash or modify the subpoena, they must do so before the return date of the subpoena, which shall be no earlier than thirty (30) days from the date of service. The account holder may use the "John Doe" pseudonym until a request for a protective order is presented and addressed by the Court, and any such request should be included at the appropriate time in the Joint or Individual Rule 26(f) Reports. FURTHER ORDERED that Plaintiff may use the information disclosed in response to such a subpoena only for the purpose of the present suit.
