PARTIAL TRANSFER ORDER AND ORDER TO AMEND....The Court directs the Clerk of Court to transfer all claims asserted in the complaint to the United States District Court for the Middle District of North Carolina. A summons shall not issue from this court at this time. All named Defendants should be terminated from this action. The Court grants Plaintiff 60 days leave to file an amended complaint in this court, should Plaintiff intend to assert a New York state law claim, arising from the 1995 alleged events that occurred in New York County. An amended complaint form is attached to this order. The Court certifies, under 28 U.S.C. 1915(a)(3), that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Court directs the Clerk of Court to hold this matter open on the docket. If Plaintiff does not file an amended complaint, the Court will dismiss the action without prejudice for failure to prosecute. SO ORDERED.
