April 10, 2019 Filing 16 TEXT ORDER granting #15 Motion for Leave to File Surreply. The Court has reviewed the filings associated with #10 Defendant's Motion to Dismiss. In these filings, Defendant repeatedly accuses Plaintiff of deliberately disregarding a forum selection clause. Such accusationsparticularly when unsupported by any objective evidenceare unnecessary and unprofessional. The Court has had numerous ERISA cases with Plaintiff's counsel and has always found her to be candid and professional in her representation of her clients. Indeed, it is unsurprising to the Court that Plaintiff's counsel acknowledges (after receiving a copy of the forum selection clause) that venue is proper in the Western District of North Carolina. Under the circumstances of this case, the Court finds that dismissal is improper as the interests of justice favor transferring venue to the Western District of North Carolina. Accordingly, the Court transfers this case to the Western District of North Carolina pursuant to 28 U.S.C. 1406(a), wherein a District Court with proper venue can rule on Defendant's 12(b)(6) Motion.
