March 5, 2024 Minute Order: TELEPHONE CONFERENCE held before US Magistrate Judge Susan C. Rodriguez. Having considered the parties' arguments, their written submissions, and the applicable law, the Court enters the following Order: Issue 1. Defendants' objections to Plaintiff deposing the six witnesses discussed during the call is OVERRULED subject to the following limitations on those depositions. The Court finds that those depositions are not duplicative under Rule 26 based on the reasons cited by the FTC, and were contemplated in the recently issued CMO (Doc. No. 48 at 9) entered by the Court on February 12, 2024. The deposition of Novant's CEO Carl Armato will be limited to a half day. Further, consistent with the Court's instructions given during the call, the parties are ORDERED to meet and confer and to work together to conduct the remaining depositions at an expeditious pace. Issue 2. Plaintiff's objection to sitting for a Rule 30(b)(6) deposition is OVERRULED. The Court has considered the caselaw cited by the parties and finds that Defendants' request is not premature and that they have shown a substantial need for the 30(b)(6) witness and an inability to obtain the substantial equivalent without undue hardship. Therefore, the Court will permit the 30(b)(6) deposition. This Order is without prejudice to Plaintiff making objections as to the scope of the Rule 30(b)(6) deposition or privilege/work product.
