MINUTE ORDER. In light of the arguments raised in the #115 Plaintiffs' Status Report and the parties' previous arguments, the Court HEREBY STAYS its #113 January 2, 2019 Order and #114 January 2, 2019 Memorandum Opinion, and the Court TRANSFERS this case to the U.S. District Court for the District of North Dakota ("District of North Dakota") pursuant to 28 U.S.C. 1406(a). Under Section 1406(a), a federal district court lacking personal jurisdiction over a defendant may transfer a case, "in the interest of justice," "to any other district or division where it might have been brought." 28 U.S.C. 1406(a); see also Dugdale v. Ditech Fin., LLC, No. 17-7137, 2018 WL 1391724, at *1 (D.C. Cir. Feb. 21, 2018). On January 2, 2019, this Court concluded that it lacked personal jurisdiction over nine defendants: (1) Samuel Peck, (2) SKE Midwestern, Inc. ("SKE"), (3) Emilio Farah, (4) Convalor, S.A.C., (5) Confactor, S.A.C., (6) Jorge Harten Costa, Sr., (7) Jorge Emilio Harten Rodriguez Larrain, Jr., (8) Ofelia Maria Rodriguez Larrain Salinas de Harten, and (9) Javier Rodriguez Larrain Salinas. Mem. Op., ECF No. 114 at 2, 49. Plaintiffs have requested that the Court stay its dismissal order and transfer this case to the District of North Dakota because two of the defendants (Samuel Peck and SKE) "would be at home in North Dakota." Pls.' Status Report, ECF No. 115 at 3. It is undisputed that SKE is subject to the general personal jurisdiction in the District of North Dakota -- the forum where it maintains its principal place of business. See Daimler AG v. Bauman, 134 S. Ct. 746, 760 (2014) (holding that the "place of incorporation and principal place of business are paradig[m]... bases for general jurisdiction" (alterations in original) (internal quotation marks omitted)). Indeed, the defendants have acknowledged that SKE's principal place of business is in North Dakota. See, e.g., SKE's Mem. in Opp'n to Pls.' Mot. for Jurisdictional Disc., ECF No. 69 at 4 n.2 ("As a North Dakota corporation with its principal place of business in Fargo, the courts of North Dakota have jurisdiction over SKE Midwestern."); Defs.' Mem. in Opp'n to Pls.' Mot. for Jurisdictional Disc., ECF No. 85 at 1 (stating that SKE's principal place of business is in North Dakota). Although the Court lacks personal jurisdiction over the nine defendants, the Court finds that transfer, rather than dismissal, is the appropriate remedy.
