September 21, 2011 Opinion or Order Filing 267 Memorandum Opinion and Order: Defendant's motion for reconsideration (Doc. No. 262 , Part 1) is granted and its motion for certification of an interlocutory appeal (Doc. No. 262 , Part 2) is denied. Upon reconsideration, the Court clar ifies that plaintiff will be given an opportunity at the scheduled jury trial to prove "loss of business value" relating to its first store which had to close and also to prove "lost return on investment" or "lost opportunity " relating to its planned second store. Plaintiff will also be given the opportunity to prove that, but for Thomasville's breach, it would have remained current on its account with Thomasville such that there would not have been a balance o n the account which could have matured to a judgment against it, eliminating its liability for interest on the judgment that Thomasville has against it. Having resolved the motion, the Court now schedules this case for a trial on damages. A separate Trial Order will issue. Judge Sara Lioi on 9/21/2011. (P,J)
September 30, 2010 Opinion or Order Filing 256 Memorandum Opinion and Order: Thomasville's motion for summary judgment (Doc. No. 239 ) is denied.
