Filing 38 Memorandum Opinion and Order: Defendants' motion for partial judgment on the pleadings (Doc. No. 14 ) is granted in part and denied in part. Defendants Richard A. Hennig and Joseph P. Szeman are dismissed from the lawsuit with prejudice on the grounds of absolute prosecutorial immunity. All claims for punitive damages are dismissed, in addition to the following claims, and the following claims survive this motion (see order for specifics). Judge Sara Lioi on 11/24/2008. (P,J) |
