Filing 23 Memorandum Opinion and Order: Defendants' Motion for Summary Judgment is GRANTED in PART and DENIED in PART. Summary judgment is granted as to defendant Bishop on all claims raised in the motion. The remaining claims against defendant B ishop are excessive force and assault and battery. With regard to defendant Dwyer, summary judgment is appropriate on all claims except the state law malicious prosecution claim. That is the sole remaining claim asserted against defendant Dwyer.
