Report and Recommendation that following review of the arguments raised in the petition and applicable law, Gilbert has not demonstrated that he is in custody pursuant to a judgment of the state appellate court which resulted in a decision tha t was contrary to or involved an unreasonable application of Federal law as determined by the Supreme Court of the United States. He has established that the state appellate court decision was the result of a decision based on an unreasonable interpr etation of the facts in light of the evidence in the State appellate court proceeding, but this demonstration did not improve his legal standing regarding his dissatisfaction with defense counsel. See 28 U.S.C. §2254(d)(1) and (2). The record discloses no error resulting in denial of fundamental fairness or cause to hesitate due to the probability of actual innocence. There has been no demonstrated need for an evidentiary hearing. It is recommended that this application for habeas corpus be denied. Objections to R&R due by 9/14/2009. Magistrate Judge James S.
