As set forth in the Court's entry, the outcome of Key's summar y judgment motion was not prejudiced by Richard Owens's misrepresentation and the relief sought is inappropriate here. Should the Sixth Circuit affirm the grant of summary judgment to Key based solely on Owens's purported lack of knowledge of plaintiff's complaints, this Court would entertain plaintiff's Rule 60(b)(3) motion to probe the veracity of Owens's statement. Finally, once this Court again has jurisdiction over the case, it would be inclined to consider a motion for sanctions if plaintiff can show that Owens's statements were false.
