Plaintiff Parma Community General Hospita l's Motion for Summary Judgment on Defendant's Counterclaim,(ECF # 72 ), is DENIED. Trial remains set for March 15, 2011 at 8:30 a.m. Trial will address Plaintiff's claim for breach of contract; Defendant's claim for breach of the December settlement agreement; and, Plaintiff's claim of fraudulent inducement (and/or defense of rescission) with regard to the December settlement.
