Filing 83 Opinion and Order signed by Judge James S. Gwin on 6/16/11. The Court grants, in part, plaintiff's motions in limine and defers until trial the ruling on the admissibility of plaintiff's medical records. Plaintiff's motion in limine is granted as to Dr. R. Agema, Dr. J. Sotelo, Dr. J. Mendez, Dr. T. Drahotusky-Dodig, K. Colon, R.N., Dr. H Perzy, Dr. H. Gottesman, Dr. A. Rosenstein, J. Prusa, R.N., and a yet unnamed MetroHealth Center records custodian. The Court partiall y denies plaintiff's motion in limine in that it will allow the testimony of Dr. R. Weiss and one treating physician from MetroHealth provided these witnesses are made available for discovery depositions as set forth in this entry. Defendants s hall pay all costs associated with the both of these depositions and failure to make these witnesses available for depositions as set out in this entry will result in the exclusion of their testimony. This partial denial is without prejudice to plaintiff raising this issue again if the late disclosure of these two witnesses proves to not be harmless. (Related Docs. 76 , 80 ) (M,G) |
Filing 65 Opinion and Order signed by Judge James S. Gwin on 6/9/11 denying defendants' motion to modify order of 6/8/11. The Court will consider no further motions on the Pink Slip issue as it has been resolved multiple times. (Related Docs. 62 , 63 ) (M,G) |
Filing 62 Opinion and Order signed by Judge James S. Gwin on 6/8/11 denying defendants' motion in limine and permitting plaintiff to introduce evidence and argue that seizure was unlawful as a means of showing that force used was excessive. The Court grants plaintiff's motion in limine and defendants are precluded from arguing that the Pink Slip required them to take plaintiff into custody. (Related Docs. 56 , 59 ) (M,G) |
Filing 34 Opinion and Order signed by Judge James S. Gwin on 1/13/11. The Court, as set forth in this entry, grants, defendants' motion for summary judgment in part. The motion for summary judgment is granted with respect to the City of Strongsv ille and denied as to Officers Stolz and Guminey. As to plaintiff's partial motion for summary judgment, the Court grants the motion with respect to Affirmative Defenses Numbers 6, 9, 10 and 11 and denies the motion as to Affirmative Defenses Numbers 4, 5 and 8. The Court denies plaintiff's motions to strike Numbers 1, 2 and 3. (Related Docs. 20 , 21 , 22 , 23 , 24 ) (M,G) |
