Memorandum Opinion and Order Plaintiff CFI fails to state plausible claims for relief because the factual allegations as set forth in Mericap's re-filed Complaint do not allege "property damage" or an "occurrence" as defined by the insurance policy with Federated. Therefore, the Court finds that Defendant Federated owes no duty to defend or indemnify CFI against the claims made in Mericap's re-filed Complaint.Accordingly, Federated's 9 motion to dismiss is granted and the case is dismissed.
