Filing 51 Memorandum Opinion and Order that for the reasons contained in this entry, defendant's 15 motion to dismiss Counts 2 and 3 of plaintiff' complaint is Denied. Plaintiffs are directed to file an amended complaint in accord ance with this Order by February 24, 2012. Further for the reasons contained in this entry, plaintiffs' 29 motion to dismiss or strike defendant's counterclaims is Denied. Because the Court has already ruled on the parties' R ule 12 motions on substantive grounds, the Court will not entertain additional motions to dismiss from either side.
