Order: The Court holds that the Ohio physician-patient privilege statute, Ohio Rev. Code § 2317.02(B)(1), has no application to CIDs issued pursuant to the authority of 31 U.S.C. Section 3733 or to subpoenas or subpoenas duces tecum issue d by a court of the United States to aid in a federal grand jury investigation. Therefore, the Petition to Modify or Set Aside Civil Investigative Demands is denied and the Petitioners are hereby ordered to comply with the two CIDs (Nos. NDAL-2011-10 and NDAL-2011-11) issued by the United States Attorney for the Northern District of Alabama. (Related Doc # 2 , 1 ). Judge Sara Lioi on 3/9/2011. (P,J)
