Filing 94 Memorandum and Order. The motion to stike 53 is granted in part, and denied in part, as outlined in this Order. The motion for leave to amend 54 is granted and the court will consider exhibit 2 to document 54 as the Defendant's am ended motion for summary judgment. The motion for summary judgment 45 as amended by 54 , DX2 is granted. The motion is granted on the ADA claim, because employers are not required to provide reasonable accommodations to non-disabled workers under the ADA. The motion is also granted on the FMLA claims.
