Filing 13 Opinion and Order. Plaintiff's Application to Proceed In Forma Pauperis (Related doc # 7 ) is granted. Claims found in Counts Six through Fifteen are dismissed pursuant to 28 U.S.C. §1915(e). The Court certifies pursuant to 28 U.S .C. § 1915(a)(3) that an appeal from this decision could not be taken in good faith. This action shall proceed solely against Officer Atha, Officer Dumont, and Chief Oliver on Plaintiff's claims set forth in Counts One through Five of the C omplaint. Plaintiff's Motion for Leave to File First Amended Complaint (Related doc # 12 ) is granted in part and denied in part. Plaintiff may file an Amended Complaint, but only to the extent that it does not re-assert any claims which are dismissed in this Opinion and Order.
