Filing 6 Opinion and Order. As set forth herein, Plaintiff's Fourth Amendment claims for use of excessive force during his arrest against Agents Morgan, Kolonick and John Doe are dismissed pursuant to 28 U.S.C. §1915(e). Plaintiff's Fo urteenth Amendment claims for deliberate indifference to serious medical needs are dismissed against all Defendants. The Court certifies, pursuant to 28 U.S.C. §1915(a)(3), that an appeal from this decision could not be taken in good faith. Th is action shall proceed solely on Plaintiff's Fourth Amendment claim for use of excessive force during arrest against Agent Garner. The Clerk's Office is directed to forward the appropriate documents to the U.S. Marshal for service of process and shall include a copy of this order in the documents to be served upon Defendant Agent Garner.
