Memorandum Opinion and Order: This action is dismissed for failing to state a claim for relief. Plaintiff's motion for service of summons is denied as moot. (Doc. No. 3 .) Plaintiff's motion for appointment of counsel is denied. Ev en though plaintiff has paid the filing fee, he has indicated his desire to proceed in forma pauperis status. Therefore, should it later become relevant, the Court hereby certifies pursuant to 28 U.S.C. Section 1915(a)(3) that an appeal from this decision could not be taken in good faith. (Related Doc # 1 ).
