Memorandum Opinion and Order. For the reasons set forth, Magistrate Judge Parker's 409 Report and Recommendation is adopted as modified within this Order. Plaintiff's objections to the Report and Recommendation are duplicative of the arguments made to the Magistrate Judge or are unwarranted.
