Memorandum Opinion and Order: Defendants' motions to dismiss (Doc. Nos. 36 and 49 ) are granted in part and denied in part. Investor Income Properties LLC is dismissed entirely from this lawsuit. Plaintiffs' claims of conversion, unjust enrichment, and breach of fiduciary duty are dismissed from the lawsuit. Any contract claims against a defendant who is not a party to the contract or which is based on actions of an entity who is not a defendant in this lawsuit are dismissed.
