Memorandum Opinion and Order granting in part and denying in part Defendants' 13 Motion to dismiss for failure to state a claim. The remaining claims following the resolution of this Motion are LaCretia McElrath's excessiv e force and assault and battery claims against Officer Collins, and Ayanna McElrath's federal excessive force and assault and battery claims against Officers Collins and Judd and yet-identified Defendants. Also remaining is Ayanna McElrath's negligent infliction of emotional distress claim. For the reasons previously explained, all other claims are hereby dismissed.
