October 24, 2017 Opinion or Order Filing 68 Order: This Court reviewed the discovery dispute outlined in the letters dated October 18, 2017 and October 20, 2017. Based on the stipulation entered between the parties, Vexor Energy of Indiana ("VEI") must respond to discovery as if it were a party to this litigation. As such, plaintiff need not issue subpoenas to secure the discovery. The Court notes that, with the exception of personal jurisdiction and venue, VEI did not waive objections to the discovery requests. This includes objections based on relevance. Nor does the Court express any ruling on whether personal jurisdiction or venue exists over potential claims plaintiff may assert against VEI. Rather, the Court simply notes that VEI waived those arguments with respect to the issuance of discovery. VEI is not a party to this case. Rather, VEI simply agreed that it would not oppose discovery based on its status as a non-party. Judge Patricia A. Gaughan on 10/24/17. (LC,S)
