Memorandum of Opinion and Order: Accordingly, the defendant's motion to dismiss the plaintiff's complaint pursuant to Fed. R. Civ. P. 12(b)(6) (Doc. No. 7 ) is granted, the plaintiff's "motion" in response (Doc. No. 8 ) is denied, and this action is dismissed. The plaintiff's motion for appointment of counsel (Doc. No. 4 ) is also denied.
