The Court grants defendants' motion for summary judgment as to Counts 1, 2, 3, and 5 and dismisses without prejudice plaintiff's claim in Count 4. The Court denies plaintiff 's motions concerning his claims he is not receiving legal mail. The Court grants defendants' motion for reconsideration of the order granting plaintiff in forma pauperis status, and grants defendants' motion to declare plaintiff a ve xatious litigator and to impose pre-filing restrictions. The Clerk is hereby ordered to reject any future requests from plaintiff to proceed in forma pauperis unless he is "under imminent danger of serious physical injury". Further, the C lerk is ordered to implement the permanent injunction as described in Section E of this Order. The remaining motions set forth in this entry are dismissed as moot. The Court certifies under 28 U.S.C. § 1915(a)(3) that an appeal from this decision could not be taken in good faith.
