September 24, 2019 Opinion or Order Filing 58 Minute Order Status conference held. Following their meeting on September 24, 2019 conducted pursuant to my order of September 12, 2019 (ECF No. #56 ), the plaintiff and defendants' counsel reported for the record that they had reached agreement on outstanding discovery disputes except for an issue regarding a request for admission/interrogatory plaintiff had propounded. Several potential resolutions to the issue were discussed, including the possibility of providing an answer to the specific discovery request, which would then be places under seal. Counsel recited on the record in detail the agreement they had reached. I ordered the response to the interrogatory/admission in dispute and hereby order the response be placed under seal. The parties agreed to file a motion with U.S. District Judge Barker to seek additional briefing time and a continuance of the conference scheduled for October 8, 2019. Because the parties have not sought a protective order in this case, and given the nature of the parties disputes, I urged the parties to consider the filing of a stipulated protective order, to avoid potential disputes over what would appear to be confidential or privileged information. I will issue a separate order under Fed. Evid. R. 502(d) to ensure that the no attorney-client privilege or work product protection is waived by disclosures connected with this case.
