Order of Dismissal. Plaintiff has filed a notice of dismissal pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i), seeking to dismiss U.S. Bank from this action and also dismiss Count One of the Complaint, alleging breach of contract against U.S. Bank and Specialized Loan Servicing, LLC., with prejudice (Doc. #17 ). Defendant U.S. Bank, and Count One of Plaintiffs Complaint, are hereby dismissed with prejudice at the Plaintiffs request, with each party to bear its own fees and costs.
