Therein, Defendant states that, on February 9, 2023, the PTAB issued a Final Written Decision judging all challenged claims of the '585 patent invalid. Defendant requests that the Court set a status conference to discuss the impact of the PTAB decision on the instant action, and to set a schedule for Defendant to seek leave to amend its affirmative defenses and counterclaims. Accordingly, a telephonic status conference with lead counsel is set for March 15, 2023 at 1:30 p.m. EST. Dial in information will be provided via separate email. May 13, 2020 Opinion or Order Order [non-document] Plaintiff's Motion for Extension of Time To Serve Complaint filed on May 13, 2020 (Plaintiff's Motion) (Doc. No. #7 ) is GRANTED IN PART. This Court issued an Order to Show Cause on May 13, 2020 because Plaintiff had failed to perfect service of its Complaint upon Defendant within 90 days. (Doc. No. #6 ). In response thereto, Plaintiff's Motion was filed asking this Court to grant it an additional 60 days within which to perfect service on Defendant, citing the COVID-19 pandemic's impact on Plaintiff's business as good cause for failing to perfect service. However, service of a complaint is the responsibility of counsel representing Plaintiff, and not the responsibility of the party Plaintiff. Therefore, Plaintiff has not shown good cause for granting it an additional 60 days within which to perfect service on Defendant. However, the Court will allow an additional 30 days to perfect service upon Defendant.
