Minutes of proceedings [non-document] After reviewing Defendants' Motion to Dismiss or Stay, Doc #: #7 , the Court scheduled a teleconference with counsel and clients on October 19, 2020. Attending the teleconference for Plaintiffs were client representatives John Berger and John Gadd and their Counsel Jennifer Gross, Benjamin England and Peter G. Pattakos. Attending the teleconference for Defendants were client representatives Steven Blustein and Sean Knecht and their Counsel Patrick Lewis and Kendall Kash. As this case has been filed in two different states (Ohio and Texas), the Court asserted its policy not to adjudicate the same case in two different jurisdictions. However, the Court offered to mediate the dispute before dismissing or transferring this case to Texas. Counsel and clients accepted the offer and agreed to hold a Settlement Conference via ZOOM beginning at 10:30 Eastern Time on Friday, November 6, 2020. The Court also instructed Counsel to email concise position papers to chambers no later than 4:00 p.m. on Monday, November 2, 2020. Finally, the Court suspended briefing on the pending motion.
