February 1, 2023 Opinion or Order Order [non-document]: The Court having previously granted multiple extensions and amendments to the Case Management Order, Plaintiff now moves (R. #40 ) to amend and revise the dates set in the most recent Order. That motion is granted in part and denied in part. The parties agree to an additional 45-day extension of fact discovery, but disagree on Plaintiff's requests to substantially enlarge the case management schedule further by bifurcating expert reports on class certification and class merits, and to further enlarge the time for expert discovery, dispositive motions, and other deadlines. Plaintiff informed the Court that he is willing to engage in settlement of the fees so long as he has the opportunity to appeal the Court's decision in regards to his tuition claim(s). The Court offered to certify the case to the Sixth Circuit and stay the case, but the parties did not consent to this course of action.
