The Court, however, will consider sealing Defendant's filings if he continues to use objectively offensive and explicitly threatening language. (Id. at PageID 1239.) No. 24) and finds that a more definite statement regarding the nature of Defendant's counterclaim is unnecessary, as Defendant did not allege one. July 20, 2023 Opinion or Order Order [non-document]: The Court recognizes that prior matters between these parties involving many of the same underlying facts in this case have been consolidated and are currently with Judge Oliver. (Case Nos. 1:19-cv-2103, 1:19-cv-2615, 1:19-cv-2589, & 1:19-cv-2786.) Those matters are further along in litigation, but any resolution in those matters may affect this litigation. The Court exercises its inherent authority to manage its docket, prioritize the appropriate use of judicial resources, and avoid the possibility of conflicting rulings or findings, and STAYS this case until a final judgment entry is issued in each consolidated case. October 12, 2022 Minutes of proceedings [non-document] before Judge Bridget Meehan Brennan. Telephonic status conference held on 10/12/2022. Attorney Bryan Reo appeared on his behalf. Defendant Martin Lindstedt appeared pro se. At the outset, the Court asked the parties whether they would consent to the jurisdiction of Magistrate Judge Armstrong. Defendant did not consent. Next, the Court addressed the pending motions. (Doc. Nos. #7 , #8 , #13 , #14 , & #15 .) The Court stated that it would deny Plaintiff's motions (Doc. Nos. #8 & #14 ) and ordered Plaintiff to respond to Defendant's motions (Doc. Nos. #7 , #13 , & #15 ) on or by November 14, 2022. Plaintiff may elect to submit one consolidated response in opposition. Defendant may reply to Plaintiff's response(s) on or by November 28, 2022. Defendant indicated that he may want electronic filing privileges. After hearing from Defendant that he had a computer, internet access, and an active email account, the Court found that Defendant is qualified for electronic filing privileges pursuant to L.R. 5.1. The Court informed Defendant that it would mail instructions for him to electronically file, but it was entirely his choice whether to submit the required forms for authorization. The Court further explained that Defendant's decision to file electronically or to continue to use mail would not cause the Court to alter the deadlines set forth by the Federal Rules of Civil Procedure and the Local Rules. Defendant acknowledged that deadlines would not be moved. Last, the Court stated it would not tolerate the offensive language found in Defendant's filings- especially slurs directed at Plaintiff. If Defendant's future filings include such language, the Court will revoke any electronic filing privileges and strike such filings from the record. Defendant acknowledged the Court's position on using language befitting this matter. The Court also reminded Defendant that he is the only named Defendant in this case and that he, as a pro se litigant, may only represent himself. April 5, 2022 Filing 11 Minutes of proceedings before Judge Bridget Meehan Brennan. Telephonic Case Management Conference held on 4/05/22. Parties advised the Court on the status of this case. Mr. Lindstedt asserted that the Northern District of Ohio was an improper venue to hear this case and expressed that the matter should be transferred consistent with Judge Gwins ruling in Reo v. Lindstedt [14-cv-00816]. The Court reminded Mr. Lindstedt of this Court's 1/21/22 Order, which stated that the Court would no longer entertain oral motions. The Court directed Mr. Lindstedt to file a motion for leave, asking this Court to allow him to amend his prior motion [ECF#7 ] to include this assertion. Mr. Lindstedt acknowledged that he did not provide Mr. Reo with the pre-discovery disclosures required by Fed. R. Civ. P. 26(a)(1) and this Courts Case Management Scheduling Order [ECF#9 ]. Mr. Lindstedt stated that he did not have access to the Courts electronic filing system. The Court informed Mr. Lindstedt that Fed. R. Civ. P. 26(a)(1) and the Courts Order provided for the exchange of these disclosures rather than filing them electronically. Mr. Lindstedt agreed to send the disclosures to Mr. Reo no later than April 8, 2022. Both parties orally consented to the jurisdiction of Magistrate Judge William H. Baughman, Jr. pursuant to 28 U.S.C. 636(c). Both parties specifically stated their consent to Judge Brennan's Courtroom Deputy executing the magistrate consent form on their behalf given Mr. Lindstedt's current inability to access the electronic filing system.
