September 21, 2022 Opinion or Order Order [non-document] STRIKING Defendant's Notice of Bankruptcy Filing and Automatic Stay. (Doc. No. #5 .) Plaintiff initiated this action against Defendant because of Defendant's alleged failure to credit all payments made in a foreclosure proceeding. (Doc. No. #1 - #2 .) The automatic stay under Section 362(a)(1) of the Bankruptcy Code "only applies to acts against the debtor." In re GYPC, INC., 634 B.R. 983, 1002 (Bankr. S.D. Ohio 2021) (internal quotation marks omitted) (emphasis added); see also Koolik v. Markowitz, 40 F.3d 567, 568 (2d Cir. 1994) ("This Court has recognized that the automatic stay is applicable only to proceedings 'against' the debtor."). A corollary to this is that "[t]he automatic stay provision of the Bankruptcy Code, 11 U.S.C. 362, does not extend to lawsuits initiated by the debtor." Crosby v. Monroe Cnty., 394 F.3d 1328, 1331 n.2 (11th Cir. 2004); see also Martin-Trigona v. Champion Fed. Sav. & Loan Ass'n, 892 F.2d 575, 577 (7th Cir. 1989) ("For in any event the automatic stay is inapplicable to suits by the bankrupt ("debtor," as he is now called)."). This rule applies even if the debtor plaintiff initiates litigation related to a foreclosure proceeding. In re Abreu, 527 B.R. 570, 581 (Bankr. E.D.N.Y. 2015) (finding that plaintiff's claims related to foreclosed property were not subject to the automatic stay because they were brought by the plaintiff). Accordingly, Plaintiff's petition for voluntary relief in the United States Bankruptcy Court of the Northern District of Ohio does not automatically stay this proceeding.
