| Minutes of proceedings [non-document] On July 19, 2023, the Court held a case management conference via Zoom. In attendance were: the Plaintiff, Vivekkumar Patel; Plaintiff's Counsel Alexander Granovsky; Defendant Hitesh Patel; and Defense Counsel Dennis DeCamillo and Cory Funk. The Court notes that Defendant Mukundkumar Patel was not present. Moving forward, Counsel and all Clients are required to attend all court proceedings, unless otherwise excused. The Court discussed the parties' negotiation efforts thus far, their desire to mediate this case, the authenticity of Exhibit A (attached to Docs. #4 , #8 ), the litigation schedule, discovery matters, and the Plaintiff's motion to dismiss (Doc. #7 ). Both sides agreed to mediate this matter before Magistrate Judge Greenburg, during the November 2023 timeframe. Prior to the mediation, the Court orders the parties to do the following: 1) Depose the two individual Defendants, the Plaintiff, and the notary who signed Exhibit A (attached to Docs. #4 , #8 ); 2) Defendants will provide the Plaintiff with any banking and financial records in their possession that relate to the counterclaims and the Defendants' assertion that the Plaintiff paid them approximately $4,000 per month; 3) Defendants will obtain corporate records from Mr. Hero and provide them to the Plaintiff; and 4) Reengage in serious settlement discussions prior to the mediation.The Court refers this case to Magistrate Judge Greenburg for mediation/settlement. The Court denies as moot the Plaintiff's motion to dismiss counterclaim (Doc. #7 ). The Court approves the litigation schedule contained the Report of Parties Planning Meeting (Doc. #6 ). The Court will refer this case to prosecution if a party submits false or fraudulent documents to the Court. The Court will hold a Zoom status conference with Counsel and all parties on Wednesday, November 29, 2023 at 12:00 pm. A joint status report is due by Monday, November 27, 2023 at 12:00 pm.
