Order [non-document]: In light of the Sixth Circuit's ruling in Clark, et al. v. A&L Homecare, et al, 68 F.4th 1003 (6th Cir. 2023), the Court sets a telephonic status conference for 12:00 p.m. September 11, 2023, to discuss the procedure for promptly addressing any potential Motion for Court-Approved Notice to Other Employees. Prior to the status conference, the parties are directed to meet and confer regarding: (1) whether Plaintiff intends to move for Court-Approved Notice to Other Employees and/or whether Defendant intends to stipulate to or oppose Plaintiff's proposed collective action; (2) if Plaintiff intends to move for Court-Approved Notice to Other Employees, proposed expedited discovery dates, a proposed briefing schedule for Plaintiff's Motion for Court-Approved Notice to Other Employees, a proposed hearing date, and the potential for stipulated tolling of the FLSA statute of limitations; and (3) any other matters the parties wish to bring to the attention of the Court. The Court will host the conference call and inform counsel by way of email of the telephone number for the conference. The parties shall dial into the Court's bridge line at least five minutes prior to the scheduled conference time. The parties are ordered to file a joint status report summarizing their meet-and-confer and proposing the dates listed above no later than 2 business days prior to the status conference.
