Minutes of proceedings [non-document] before Magistrate Judge Thomas M. Parker. Case Management Conference held via telephone on 9/13/2023. Attorney Stuart R. Settle appeared on behalf of Defendant Trans Union LLC. Pro se plaintiff, Marcel Cunningham, did not dial into the call nor did he appear in person. The court inquired about defense counsel's ability to contact plaintiff. Defense counsel informed the court that plaintiff reached out on 7/26/2023 via email to make a settlement demand but has not been responsive since that correspondence. Defense counsel also represented that he attempted to contact plaintiff using that same email address about a planning meeting around 9/6/2023 to no avail. As a proposed resolution, defense counsel suggested that the court give plaintiff 7 days to respond to show cause for his unresponsiveness and, if no cause is shown, that this matter be dismissed without prejudice for want of prosecution. After consideration, the court orders plaintiff to show cause as to why he has been unresponsive within 14 days. If plaintiff fails to show cause for his unresponsiveness, then this court will recommend the dismissal of this matter without prejudice for want of prosecution.
