Order [non-document]: Before the Court is a Stipulation (Doc. No. #15 ) and Joint Motion for Dismissal filed jointly by Plaintiff and Defendant Community Insurance Company (Doc. No. #16 ). Both filings invoke Fed. R. Civ. P. 21, which provides in pertinent part: "On motion or on its own, the court may at any time, on just terms, add or drop a party." The Joint Motion is GRANTED. The claims against Defendant Community Insurance Company are DISMISSED without prejudice. The basis for removal of this action was that claims against Defendant Community Insurance Company were governed by federal ERISA law, which therefore supplied federal question subject-matter jurisdiction under 28 U.S.C. 1331. (Doc. No. #1 at PageID# 2-3.) That basis is no longer present in this action. The parties are not of diverse citizenship, so there is no basis for jurisdiction under 28 U.S.C. 1332. (See Doc. No. #1 - #2 at PageID# 11.) "When all federal claims are dismissed before trial, the balance of considerations usually will point to dismissing the state law claims, or remanding them to state court if the action was removed." Gamel v. City of Cincinnati, 625 F.3d 949, 952 (6th Cir. 2010) (quoting Musson Theatrical, Inc. v. Fed. Exp. Corp., 89 F.3d 1244, 1254-55 (6th Cir. 1996)). On its own motion, the Court has considered the factors set forth in Carnegie-Mellon University v. Cohill, 484 U.S. 343, 352-53 (1988) and concludes that the wrongful death claims here under Ohio law are best suited for adjudication in Ohio courts. Minutes of proceedings [non-document]: A telephonic Case Management Conference was held on 11/2/2023 before Judge Bridget Meehan Brennan. Attorney Charles Murray participated on behalf of Plaintiff. Attorney Zackary Stillings participated on behalf of Defendant Community Insurance Co. Attorneys Christopher Mars and Brett Perry participated on behalf of Defendants North Ohio Heart Center, Inc. and Dr. Alberto Diaz. Plaintiff's counsel was advised that his purported Rule 26(f) submission did not comply with Fed. R's Civ. P. 16(b) and 26(f) or with this Court's Case Management Scheduling Order dated 10/6/2023.
